Ohio | Ohio media sues Sec. State Blackwell for access to polls
As another result of the ordinance O.R.C. 3501.35, the media has sued Secretary of State Blackwell for access to the polls. O.R.C 3501.35 […]prohibits loitering near polls, proscribes any person, not “an election official, employee, witness, challenger, or police officer,” from entering “the polling place during the election, except for the purpose of voting.” That section also states that, “no person shall loiter or congregate within the area between the polling place and the small flags of the United States placed on thoroughfares and walkways leading to the polling place…” This section of Ohio law has never been interpreted in such a way as to prohibit reporters and photographers from entering polls to report upon events therein or to take photographs. Original PDFs here. Come now the plantiffs, Beacon Journal Publishing Company (“Beacon Journal”) and M. Charlene Nevada (“Nevada”), by and through their undersigned counsel, and for their Complaint against the Defendents in this action, respectfully aver as follows: Nature of Action: This was filed Monday - it may not be decided upon until the polls are already open. More as it develops. Cross posted here. Posted by Chublogga at November 1, 2004 11:40 PM | TrackBack Comments
OK, I‘ll admit it. I grew up there, went to school there, and have spent most of my life there. Given the nature of the big-city press in Ohio, I’d trust Ken Blackwell to guarantee a peaceful election, a lot sooner than I would trust the newspapers. The only news outlet I know of, that isn’t totally bent to the liberals (or playing pop schmaltz), is WTVN on AM 610. My totally off-the-cuff, unqualified advice to anyone confronted by any media/reporters/cameras: Tell them that they are not allowed to use your likeness, voice, or words in any way whatsoever, not even to say that you had no comment. And if they do, you’ll sue their asses from here to kingdom come. Posted by: gus3 Given the liberal media bias, I can see how their presence might affect things at the polls - however, I don’t see what their problem is with being 100 feet away - they can still do exit-polls, they just have to wait a few extra seconds for the voters to walk far enough out. I personally would prefer not to be harrassed by the media at the polls. Maybe they’d feel differently if we followed them around with cameras all day :) Posted by: chublogga Post a comment
