Command Post 2004 Polls | California Supreme Court Halts San Francisco Gay Marriages

The Supreme Court of California, earlier today, halted gay marriages in San Francisco. Here’s an excerpt from the late-breaking story in the L.A. Times:

The California Supreme Court today halted same-sex weddings in San Francisco until it could decide whether local authorities have the right to ignore state laws that limit marriage to heterosexuals.

The seven-justice panel will hear arguments sometime in the spring.

In the unanimously approved order, the justices made it clear that they would be considering only one question — whether San Francisco officials could defy state law, and not whether same-sex couples have the right to marry.

Today’s ruling is a major setback to San Francisco officials and their allies in gay rights groups who were hoping to have the high court consider their argument that the state Constitution bars discrimination against gay couples.

It was bound to happen eventually, Both sides of this debate are getting the lawyers ready to take this to the courts no matter which way the supreme court rules.

As for that spy lady, wooowee kinda scary hippy, being a peace protester is one thing but treason is a whole new ballgame no matter which side of politics your on. My money is on thats just a front shes putting on, since the press reported that she had recieved 10,000$ in payoffs for the information she provided to her contacts. Hippys are more concerned about thier warm fuzzies, and not the pot smoking bankroll. Heres to hoping she gets 20 years in prison…..in Iraq.

Saw that, spy thing, oops! busted! I hope there is a kerry connection somehow, that would make my year… The democrat connection is good enough though.

as for the gay marriage law breaking thing, hell, the court has to determine if they broke the law by defying state law?
What? has the USA gone completely insane?

If they find they didn’t, which is what those democrat judges will probably do, then everyone may as well go ut and break state laws they feel they don’t like.
I’m beginning to wonder if the USA can be trusted to be in possesion of nuclear weapons……

The SC exists to review questions of law and lower court decisions. What is being discussed here is a LICENSE, which is a matter of State jurisdiction. There may be huge differences in how states deal with all kinds of issues relating to licenses. It’s a matter for the states to decide. We don’t need any more judges legislating from the bench - on any level, and we surely do not need any fiddling with the Constitution.

If the law is against the California constitution, then breaking it carries no penalty.

I think that’s what’s going on. Couldn’t tell you, though.

Is the California Supreme Court deciding “whether local authorities have the right to ignore state laws” in general, or just laws that the media is against?

Either way, quite a good precedent to set!
